Through Resolution No. 20223040044945 of 2022, the Ministry of Transport has established a new technical regulation for safety glass used in motor vehicles and trailers. This regulation will come into effect on February 23, 2025, and it is crucial for importing, manufacturing, and commercializing companies to be prepared for its implementation.

Below, we explain the most relevant aspects of this resolution and how it may affect your logistics and customs operations.

What does this resolution regulate?

The new technical regulation sets out the requirements that safety glass (such as windshields, windows, and rear windows) manufactured, imported, or commercialized in Colombia must meet. These requirements aim to ensure user safety and prevent risks associated with the quality of these components.

The regulation applies to both new vehicles and safety glass intended for spare parts. Additionally, it aligns with international standards, such as the UN Regulations and the Federal Motor Vehicle Safety Standards (FMVSS) of the United States.

When does it come into effect?

The resolution will come into effect on February 23, 2025. This means that, from that date, all safety glass entering the country or commercialized in Colombia must comply with the established technical requirements.

However, it is important to note that, during the 12 months following the effective date, the commercialization of vehicles and safety glass manufactured or imported before that date will be allowed without the need to comply with the new regulation. Companies must retain and present documentation proving the manufacturing or import date.

Exceptions and Procedures in the VUCE

One of the most important aspects of this resolution is that, if your product qualifies for an exception or exclusion, it must be explicitly reported during the process through the Single Window for Foreign Trade (VUCE). Additionally, all documentation demonstrating the applicable exception must be attached.

Some of the exceptions included in the resolution are:

Safety glass used in industrial machinery not intended for use on public roads.

Vehicles for sports competitions or exhibitions.

Safety glass that is part of classic or antique vehicles.

Products intended for testing or certification processes.

It is essential that, when carrying out the procedure in the Single Window for Foreign Trade (VUCE), you identify the applicable exception and provide the necessary supporting evidence to back up the corresponding exception.

Tariff Codes and Compliance with the Regulation

A key point highlighted in the resolution is that the tariff codes mentioned in the regulation are only indicative. This means that if a product is considered safety glass under the regulation, it must comply with the established technical requirements, even if its import or commercialization is carried out under a different tariff subheading.

In other words, no matter how the product is classified in the tariff nomenclature; if it is safety glass, it must comply with the provisions of the resolution.
